Dear Mr. Hart,

We are a personal injury firm in Portland and are currently representing two clients with lawsuits against Hyster Company. Both suits (one resulting in serious injury and the other resulting in the death of our client) involved the use of Hyster forklifts that were not equipped with any automatic back-up alarm or warning lights. We are attempting to build a database of complaints filed against Hyster/NACCO with similar circumstances.

I am writing to request a copies of complaints your firm filed in similar cases.

I look forward to hearing from you regarding the above matter.

This case is very interesting to me since I am a certified safety trainer and
aerial lifts and forklifts are two areas that I do alot of training on. Back-
up alarms are of course required now and have saved several people from
injuries. One problem is that in those areas where forklifts are, many times
the decibel level is so high the employees have a hard time hearing the alarm
until they are almost in trouble. Safety needs to begin with everyone in the a
area of equipment not just the drivers.

Sure that may be ok for most injuries but how about the 19 year old who is hit by a drunk driver and winds up in a wheel chair for life and needs around the clock nursing assistance? The one who can't even feed herself and is expected to live until her late seventies?

One size just doesn't fit all. Thanks for contributing.

This article was very thought provoking. I sometimes sign paperwork without reading all the fine print. I will be more focused on what I am signing in the future. Thanks for the article and I enjoyed your website.

I thought that when you joined a gym yo automatically gave up your rights to make a claim if you are hurt? Check out the fine print on the back of the contract. Thanks Paul
